Terms and Conditions

The terms and conditions contained herein and those described on the Company’s website (to be read in combination and referred to herein in their entirety as “The Agreement”) shall be binding on each and every customer of GoldBuyerKing. If you would like a copy of the information on our website, please call our Toll Free Number.

Optional Express Methods of Payment

Standard method of payment is by Company Check. Company Check will usually arrive by USPS within 2-5 days. If you choose to be paid via by any of our express Optional Methods of Payment (BankWire, PayPal, Western Union, Certified Bank Check, or Money Order) you waive the 17 day return guarantee. As soon as your items are evaluated you will be paid and the items will be sent to a third party refinery for melting. Please call us before your items are evaluated if you would like a Company Check instead.

Requirements for Use

By state and federal law, every customer must be at least twenty-one (21) years of age in order to sell precious metals or jewelry to GoldBuyerKing. In addition, every customer must be the actual legal owner of any and all gold, jewelry, and other property sold or attempted to be sold to GoldBuyerKing. Every customer must be acting on his or her own behalf and not as the agent or representative of another person. GoldBuyerKing does not purchase stolen merchandise. GoldBuyerKing may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph. By shipping your goods to GoldBuyerKing, you are agreeing to all terms and conditions set forth herein and those described on our website: GoldBuyerKing.com.

Guarantee against Loss

GoldBuyerKing will guarantee against loss of the total contents properly shipped to GoldBuyerKing via USPS in accordance with the instructions and procedures established by GoldBuyerKing and subject to the terms and conditions herein and as described at GoldBuyerKing.com. Every GoldBuyerKing SafePaq Business Reply Mail envelope is insured up to $100. GoldBuyerKing reserves the right, in its sole discretion, to reject delivery of any mail, envelope or package which appears to be damaged, opened, or tampered with and any such mail, envelope or package will be returned by the post office to the customer. GoldBuyerKing shall have no liability to any customer for any such attempted delivery or return of any such items. If the customer requests a different shipping method, shipping cost and insurance cost must be paid for by the customer at the customer’s own discretion.

Limitation of Liability

This limitation of liability shall be binding on each and every customer and any third party, including, but not limited to, the customer and the customer's successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to customer's transaction with GoldBuyerKing. In no event shall GoldBuyerKing be liable for any damages from the loss or destruction of property in its possession for any reason, including negligence, except as stated herein. In no event shall GoldBuyerKing be liable to any third party, including any insurance carrier. GoldBuyerKing shall not be liable for any subrogation claim brought by the customer's insurance carrier, and, by submitting an item to GoldBuyerKing, customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.

GoldBuyerKing’s liability is and shall be expressly and specifically limited to the LEAST of the following sums:

The liquidation value placed on the total contents by GoldBuyerKing in GoldBuyerKing’s sole discretion.

-OR-

One-third (1/3) of the appraised value of the contents according to an appraisal submitted by a customer/seller to GoldBuyerKing, which appraisal was issued prior to the shipment of the item to GoldBuyerKing; and,

-OR-

The sum of Five Hundred ($500.00) Dollars.

The customer/seller expressly acknowledges and agrees that if there is no appraisal which was issued prior to the contents begin submitted to GoldBuyerKing, GoldBuyerKing’s liquidated value shall be conclusive and binding and further, that in no event shall GoldBuyerKing’s Liability exceed Five Hundred ($500.00) Dollars.

GoldBuyerKing shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above. By submitting the items, customer explicitly and expressly accepts this limitation of liability.

If you believe your gold jewelry or other property is worth more than $100.00, we recommend that you insure your shipment for more at your own expense using any carrier you choose. We also strongly advise that you list the contents of your SafePaq on the enclosed brochure, which you must return to us.

Verbal Offers

Any customer or prospective seller may request GoldBuyerKing to provide a telephone or e-mail quote for his or her items after such items have arrived at GoldBuyerKing processing facility. Verbal offers may, at the discretion of GoldBuyerKing, be recorded. Upon a verbal acceptance by the customer of the telephone or e-mail quote, payment will be issued by GoldBuyerKing within twenty four (24) hours of such acceptance, and the seventeen (17) day customer satisfaction holding period guaranty will no longer be applicable to such transaction.

Referral Program

Referral checks are available when the customer actually makes a sale to GoldBuyerKing. Gold must become property of GoldBuyerKing. GoldBuyerKing may take up to a month to process a referral check due to the 17 day guarantee return policy. The $25 referrer bonus is only valid on scrap gold, silver, and platinum jewelry sales. The $25 is redeemable only when the referred customer is paid in the amount which exceeds $200 at one time for their unwanted jewelry. Coins, Watches, and diamonds are excluded from the referral program. Due to the small profit margin on Bullion/numismatic coins there is no referral bonus on these types of purchases.

Gold Chart and EZ Calculator Disclaimer of Liability

GoldBuyerKing shall not be responsible for the contents of the gold chart data appearing on its website. These charts are prepared by third parties other than GoldBuyerKing, and GoldBuyerKing includes such charts only for general information to its customers, and GoldBuyerKing shall not be liable to anyone who relies on the information contained therein. The amount which appears on the EZ Gold Calculator is in no way a binding quote. It is designed simply to assist the customer as to the expected amount and may differ from the actual amount of payout. The EZ Gold Calculator is for the sole purpose of educating the customer as to how the amount of payout is generally conceived.

Return Insurance Liabilities

 If you elected payment by company check and you change your mind about selling your Jewelry, you must notify us either by email or by phone no later than 17 days after the date upon which we issue payment to you. If you do not contact us within this period of time, the Jewelry will be sold and melted by a third party and we will no longer be able to return it to you. This 17-day return period cannot be altered for any reason, and we will not be responsible for any loss or damage of any kind if you do not contact us within this return period for return of Jewelry. All Jewelry will be shipped back to you via USPS and insured for no more than the amount we offer you (regardless of what you insure the Jewelry for when you mail it to us), unless you notify us by phone or by email that you agree to pay for the additional insurance you request. GoldBuyerKing, in its sole discretion, will choose the return carrier, insurance and receipt verification method for each transaction, unless specified otherwise by the customer.

Describing Merchandise

You agree to accurately list and describe the Merchandise that you send to us on an Check-Off Inventory List, which you can print from our website or receive from us by mail. If we determine, in our sole discretion, that there are significant discrepancies between the Merchandise as described on your inventory card and the items we receive, or if no Check-Off Inventory List was included in the package, we may suspend or terminate the Transaction with notice to you. In the event that we terminate the Transaction, we will ship your Merchandise to you within 2 business days at our cost by the USPS shipping method of our choosing, and you agree that we will only be responsible for insuring the value of your Merchandise up to $100.

Determining Your Settlement Offer

We will determine the value of your Merchandise using a calculation based primarily on the PM London Gold fixing on the day we process your Merchandise, a formula based on the karat and weight of the Merchandise, and any other factors that we deem to be appropriate. The total pennyweight (DWT) column, used in determining the price for a given metal type and quality, will be calculated based on the total number of pennyweights of gold and platinum sent in your SafePaq.

We will make the value of your Merchandise available for viewing online using our exclusive service, the TrackSafePaq feature on our website. Once you submit your request for a package you will have the opportunity to select a payment method online. You agree that you fully understand how to use TrackSafePaq.

Settlement

Upon processing your Merchandise, we will notify you by email or telephone that your Merchandise and our settlement payment for your Merchandise ("Settlement") is available for you to view on our website by logging into your customer account using TrackSafePaq. You must accept or decline your Settlement within 24 hours after we send our "Settlement Notice" to you by logging into your customer account on our website using TrackSafePaq and accepting or declining the Settlement. If you have not logged into your customer account on our website using TrackSafePaq to accept or decline your Settlement within the time frame set forth above, and have not contacted us to express your intent to the contrary, then you will be deemed to have accepted the Settlement, and we will issue payment of your Settlement via Company Check unless, specified otherwise be the customer. If you did not select any optional methods of payment on your SafePaq, then payment shall be made via company check by United States Postal Service and mailed within 24 hours. Upon your acceptance of the Settlement (either affirmatively, or by failing to decline or accept the Settlement within the time frame set forth above), we will send your Settlement to you at the address listed in our records by the end of the next business day after we receive your Merchandise in accordance with the method of payment you selected for your Settlement.

Print Your Own Kit

Print Your Own Kit was designed for the convenience of the customer. If the customer chooses to print their own kit, they are solely responsible for their own method of packaging. If GoldBuyerKing Business Reply Mail shipping label is used, it is insured up to $100. Additional Insurance can be purchased at the Post Office. Please call for directions on how to purchase additional insurance. Customers are encouraged to accurately describe all the items being sent in the Check-Off Inventory List. GoldBuyerKing will not be responsible for any item not described in the Check-Off Inventory List.

Material Return

If you change your mind about selling your material or are dissatisfied with the amount of the payment you received, you must notify us immediately. If we do not hear from you by telephone or fax within SEVENTEEN (17) DAYS of the date on the check we mailed to you, your material will be processed by our refiner. You must return the uncashed/original check before we will return your material. This time limitation cannot be waived for any reason. GoldBuyerKing will not be responsible for any loss or damage of any kind if the time limitations are not strictly followed.

Waiting Period For A Claim

A customer who wishes to submit a claim to GoldBuyerKing must NOTIFY THE COMPANY IMMEDIATELY TO REQUEST A CLAIM FORM. In order to be processed, the claim form must be fully and accurately completed, signed and mailed to GoldBuyerKing in accordance with the claim form instructions. The customer must submit any and all supporting documentation with the completed and signed claim form. Failure to properly complete, sign and/or mail the claim form WITH PROOF THAT THE GOODS WERE MAILED TO GoldBuyerKing will result in the denial of the claim by GoldBuyerKing. There is a 30 day waiting period from the time the claim form is received by GoldBuyerKing and the claim is processed.

Electronic Signature

FOR PURPOSES OF THE TRANSACTION, YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, RECEIPT OF NOTICES BY E-MAIL, USE OF ELECTRONIC CONTRACTS, AND TO ACCEPT THESE TERMS AND CONDITIONS BY ELECTRONIC MEANS. YOU AGREE THAT CLICKING THE SUBMIT BOX AT THE END OF THE GOLBUYERKING.COM GET STARTED FORM CONSTITUTES YOUR ELECTRONIC SIGNATURE.

Choice of Law, Waiver, and Claims

The Agreement shall be governed by the laws of the State of New York without regard to its conflict of law provisions. GoldBuyerKing’s failure to exercise or enforce any right or provision of the Agreement will not be deemed to be a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by GoldBuyerKing must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the State of New York. GoldBuyerKing shall be entitled to reimbursement for any and all costs incurred by it in defending any civil action filed or attempted to be filed in any jurisdiction outside of the State of New York, including but not limited to, attorney's fees incurred by GoldBuyerKing.
